General


As a customer of Freestyle Swim, it is your responsibility to read and understand our policies, procedures, rules and expectations including our code of conduct. The purpose is to ensure a safe and positive environment by making you aware that there are requirements and expectations, at all times, of appropriate behavior consistent with Freestyle Swim's core values. We support equal opportunity, prohibit discriminatory practices and are committed to providing an environment in which all individuals are treated with respect and fairness. If you do not follow these, in our sole discretion, (i) your association with Freestyle Swim can be terminated and (ii) a return of fees paid - in whole or in part - is at the sole discretion of Freestyle Swim.

Dress Code, Regulations, Photo Media Release and Access to Premises


All children under the age of 4 years old and any child who is not 100% potty trained are mandatory required to wear reusable swim diaper/or trunks and disposable swim diapers (i.e. Huggies Little Swimmers) under reusable diapers, but not alone. Regular disposal diapers are NOT permitted in the pool. All children over the age of 4 years old and all the parents who will participate in the parent & child class are required to wear formal swimsuits and/or trunks, caps and goggles. Freestyle Swim has the right to immediately terminate that parent/child's use of facilities if they are not following the dress code. Freestyle Swim is NOT a drop off program and is NOT equipped to provide before or after class supervision. For the safety of your child, parents are required to stay in the facility during all classes. Parents are expected to bring their child(ren) and report for class 5 to 10 minutes in advance. For the safety of all, no food or drinks are allowed in the pool area.


Freestyle Swim periodically takes photos and videos of classes for training, promotions, & social media outlets. Student's personal information (i.e. last name, age, etc.) will never be used. If you do not want the student's photo taken or used, you must fill out a Photo Media Refusal Form (available in the office). This form MUST be signed by a guardian and returned to the office. This form does NOT prevent other clients from taking pictures. By agreeing to this policy you agree that Freestyle Swim can take and use images of the student unless a Photo Media Refusal Form is submitted.

Pool Closures


In the event your location is closed due to weather, mechanical issues, a fecal accident, or instructor unavailability - you will be granted an automatic make-up lesson that never expires. If a student has a diarrheal incident, the student is not able to enter the pool for 14 days of the last symptoms per the New York Health Code.

Absent Instructor


We believe that continuity of lessons is of the utmost importance. Therefore, in the event of an absent teacher, a substitute teacher may be provided. Notice will not be given. If, upon arrival, you decide you would prefer not to swim with a substitute teacher, you may cancel your lesson and receive a make-up lesson. If we can not provide you a substitute teacher, we will issue you a make-up lesson to your account.

Registration and Payment of Fees


a. Payment of Fees:

In all Freestyle Swim Program, upon registration and before classes start, at least 50% of total fee must be paid in order to reserve the student's place in class. If that percentage of the fee is not fully paid, there is no guaranty that the student will have a place in the class. The remaining balance of the fee must be paid in full before the first class starts or the student will not be allowed to attend class. Fees may be paid in cash, zelle or by check made payable to "Freestyle Swim." A dishonored check is subject to a $35.00 service charge. Except for exceptional circumstances as determined in the sole discretion of Freestyle Swim, registration fee of $50(Long Island) /$30 (Queens) will be charged to new students and $0 to returning students. The registration fee will be charged immediately upon enrollment and is non-refundable. Students are required to complete a registration form and provide payment for each swim session. Enrollment is on a first come first served basis. Enrolling in one swim session does not ensure the same class placement in the following group swim session. Re-enrollment is required.

b. Regular Long Term Swimming Class (All Year Around):


This is known as the "long" training program consisting of 10 classes to be completed in one session per week to be completed in 10 consecutive weeks (excepting e.g., holidays) and 20 classes in two session per week to be completed in 10 consecutive weeks(again excepting e.g., holidays),etc. All classes (including make-up, adjourned, or otherwise) must be completed within the selected time period and there are no make-ups or adjournments for any reason into another time period except the child(ren) is entitled to two leave of absence for the 10 class sessions, four leaves of absence for 20 class sessions, etc. A student's failure to attend classes is chargeable against the student and there are no refunds, in whole or in part, for missed classes. Parents are reminded that there are only a limited number of students for each class and if his/her/their child does not attend classes or membership is terminated, another child is being deprived of the opportunity to attend classes. thus, reimbursement for missed classes (including illness and menstruation) or termination of class attendance is at the sole discretion of Freestyle Swim.

c. Summer Monday to Friday Fast Track Program (late June to September):


All Summer Monday to Friday Fast Track Program registrations must be for a minimum of two weeks (10 classes). In the Summer Fast Track Program, there is no "make-up" for classes missed and all classes must be completed within the time period selected.

d. Private Class:


Any private lessons must be used within the semester they are purchased. Any remaining lessons at the end of the semester will not roll over into the next semester, but instead will expire without refund or reschedule. Please review the start and end dates on your receipt/class schedule to ensure that this does not occur.


Cancellations must be made at least 24 hours in advance. Weekend or Monday lessons must be canceled before 5pm on Friday. Only two lessons out of every 10 pack can be cancelled and rescheduled, including those in semi-private lessons; any more than two lesson cancelled will be forfeited without a refund. Partial refunds/Reschedule will only be issued for medical reasons, in which case a doctor’s note must be presented. If a participant does not show up for a scheduled lesson or cancels with less than 24-hours-notice or after 5pm on Friday, the lesson will be forfeited. If a participant in a semi-private lesson cannot attend for any reason, the lesson should be rescheduled; otherwise the missing party will forfeit the lesson.

e. Class Withdrawal or Cancellation:


Note that every Long Term Swimming Class session has 10 classes, for those who have been / will be absent for more than 2 classes, we advise you to apply for refund as early as possible, so that you can use the refund price for future sessions. Any and all issues concerning class withdrawal or cancellation absolutely require the customer/parent to appear in person at Freestyle Swim's main office. Parents are reminded that classes cannot be "transferred" and, except as otherwise set forth in these Policies, Procedures, Rules and Expectations, registration fees are non-refundable. Furthermore, a $50 default penalty will be charged for each cancellation or withdrawal. Refunds, if any, will only apply to classes after in-office notification of withdrawal or cancellation is received.

f. Policy on Discount Packages:


Freestyle Swim offers various discount packages to those interested in registering for more than two Sessions. Discount packages are available at lower cost but Freestyle Swim reserves the right to change the packages from time to time. Because discount packages allow the customer to enjoy the facilities of Freestyle Swim at a lower cost, there are strict policies concerning customers who do not complete the entire package. For example, if a discount package is for 40 classes (4 sessions) and the customer decides to terminate after 30 classes, a refund, if any, will be calculated by multiplying the 30 days of attendance times the normal daily rate, plus a $100 processing fee, and then subtracting the amount paid by the customer for the discount package.
